Terms of Use

These Terms of Use (“Terms”) govern your use of Colorize Photos and its related services (collectively, the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and Accounts

You must be legally capable of entering into these Terms. The Service is not directed to children under 13. The App may create an internal account identifier, and you may choose to protect or recover your account using Sign in with Apple. You are responsible for activity performed through your account and for maintaining control of your device and Apple account.

2. The Service and Third-Party AI

The Service restores, colorizes, and edits photos using automated artificial-intelligence processing. To perform a generation you request, the Service sends a resized copy of your selected photo, your selected color style, and any editing instructions to Alibaba Cloud Model Studio, a third-party AI processing provider.

The App provides a separate data-sharing notice and asks for your explicit permission before the first upload or AI request. More information is available in our Privacy Policy.

AI-generated colors, details, restorations, and edits are interpretations. Results may be inaccurate, incomplete, unexpected, or historically incorrect. You should review every output and must not rely on it as an authentic historical record, professional opinion, or evidence of real events.

3. Your Content and Permissions

You retain your ownership rights in photos, instructions, and other content you submit (“Your Content”). You grant us a limited, non-exclusive license to host, copy, transmit, resize, process, modify, display to you, and delete Your Content solely as needed to operate the Service, provide the result you request, maintain your History, secure the Service, and comply with law. This license ends when the applicable content is deleted, except for limited copies retained as legally or technically necessary.

You represent that you own Your Content or have all rights and permissions necessary to upload and process it, including appropriate permission when a photo depicts another person. You are responsible for Your Content and your use of generated results.

4. Acceptable Use

You may not use the Service to:

• violate any law or another person’s privacy, publicity, intellectual-property, or other rights;
• upload content you do not have the right to process;
• create deceptive, abusive, exploitative, sexually explicit, hateful, violent, or otherwise unlawful content;
• impersonate another person, facilitate fraud, harass someone, or falsely present an AI-generated image as authentic evidence;
• probe, disrupt, overload, bypass, reverse engineer, or gain unauthorized access to the Service;
• use automated means to scrape or abuse the Service; or
• resell or commercially redistribute access to the Service without our written permission.

We may reject a request, remove content, restrict access, or suspend an account when reasonably necessary to enforce these Terms, protect users or providers, or comply with law.

5. Credits, Subscriptions, and Purchases

Some features require credits or an auto-renewable subscription. Current products, prices, billing periods, included credits, and benefits are displayed in the App before purchase. Prices and availability may vary by storefront and may change as permitted by Apple’s rules.

• Payment is charged to your Apple ID when the purchase is confirmed.
• An auto-renewable subscription renews unless you cancel it at least 24 hours before the end of the current billing period.
• Your Apple ID may be charged for renewal within 24 hours before the current period ends.
• You can manage or cancel subscriptions in your Apple ID subscription settings.
• Credits have no cash value, cannot be transferred, and may be subject to the product conditions shown at purchase.

Purchases and refunds are administered by Apple under Apple’s applicable terms. We do not directly process refunds. You may request a refund through Apple Support.

6. Service Availability and Changes

AI and cloud processing depend on network access and third-party services. We may modify, suspend, discontinue, limit, or update parts of the Service, models, styles, credit costs, or provider integrations. We will provide notice or request renewed permission when required by law or when a material change affects personal-data sharing.

7. Intellectual Property

The Service, including its software, interface, branding, designs, and non-user content, is owned by us or our licensors and is protected by applicable intellectual-property laws. Subject to these Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable license to use the App.

8. Privacy

Our Privacy Policy describes how information is collected, used, shared, retained, and deleted, including sharing with Alibaba Cloud Model Studio for AI processing. The Privacy Policy is incorporated into these Terms.

9. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We do not warrant that the Service will be uninterrupted, error-free, secure, or that AI results will be accurate, authentic, suitable for a particular purpose, or free of artifacts. Nothing in these Terms excludes rights or warranties that cannot lawfully be excluded.

10. Limitation of Liability

To the maximum extent permitted by law, we and our suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or opportunities arising from use of the Service. Our aggregate liability for claims relating to the Service will not exceed the greater of the amount you paid for the Service during the 12 months before the claim or the minimum amount required by applicable law. These limitations do not apply where prohibited by law.

11. Termination

You may stop using the Service at any time and may delete your account in Settings. We may suspend or terminate access if you materially breach these Terms, create risk or legal exposure, abuse the Service, or if required by law. Provisions that by their nature should survive termination will remain effective.

12. Changes to These Terms

We may update these Terms. We will post the revised Terms with a new effective date and provide additional notice when required. Continued use after revised Terms become effective constitutes acceptance to the extent permitted by law.
